1Who we are

This website, webpages.com.au, is operated by Peter Clark, ABN 65 664 717 383, trading as Poida Bogan, WebPages.com.au and Dolphin WebPages ("we", "us", "our").

In these terms, "you" means the person using this website or buying from it. Contact for everything, including anything in these terms, is info@webpages.com.au.

These terms cover webpages.com.au and its sections, including the shop, the School of Boganster crypto course, the School of Bogans English course, Eleven, Bogan Beach Bash and the free reading material.

2Accepting these terms

By using this website or buying anything on it, you agree to these terms, our Refund Policy and our Privacy Policy. If you don't agree, please don't use the site.

You must be at least 18 years old to buy from us, or have the permission of a parent or guardian who accepts these terms on your behalf.

3What we sell

We sell four different kinds of thing, and different rules apply to each.

Product descriptions, features and prices can change. The terms that apply to your purchase are the ones published when you bought.

4Accounts and access

  • An account is for one person. Don't share your login, and don't buy one licence for a team, a class or a group.
  • Keep your password to yourself. You're responsible for what happens under your account. Tell us immediately if you think someone else has got into it.
  • Access codes are single use and tied to the account that redeems them. Once redeemed, a code can't be moved to another account, resold or transferred.
  • Give us accurate details. If your email address is wrong, we cannot deliver what you bought.
  • Course access continues for as long as we offer that product. If we ever retire a course, we'll give existing buyers reasonable notice and a way to keep or download what they paid for.

5Prices and payment

  • Prices are in Australian dollars (AUD) unless the product says otherwise. The live one-to-one English lessons are billed in US dollars, which is stated on that product.
  • Payments are processed by Stripe. We don't see or store your full card number.
  • Your bank may add currency conversion or international transaction fees. Those are between you and your bank.
  • Subscriptions renew automatically until cancelled — monthly plans monthly, yearly plans yearly. Cancel any time by emailing info@webpages.com.au; see the Refund Policy for exactly what cancelling does.
  • If a payment fails, we may suspend access until it's sorted out.
  • If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full instead of supplying it.

6Digital products

Digital products are supplied as files for your own personal use. When you buy one, you get a personal, non-exclusive, non-transferable licence to read and use it. You don't buy the copyright.

You may:

  • download it, keep your own backup copy, and print a copy for your own use.

You may not:

  • share, upload, resell, sublicense or give away the file;
  • post it anywhere others can download it; or
  • use it to teach a paid class or build a competing product without our written permission.

Download links expire after seven days. That's a security measure, not a limit on what you bought — email us any time and we'll issue a fresh link at no cost.

7Courses and memberships

  • Course content is for your own learning. Don't record, republish, redistribute or re-teach it commercially.
  • Downloadable course materials — spreadsheets, templates, scripts and code — are provided for you to use in your own trading, study or business. You may adapt them for yourself. You may not redistribute or sell them.
  • Any code, script or indicator we supply is an example, not a product warranty. Test it yourself before relying on it, and never run trading code with real money you can't afford to lose. See section 12.
  • Courses are updated over time. We may add, change or remove lessons to keep material current.
  • Where a course includes community or group access, we may remove anyone who abuses it.

8Physical goods

  • We ship to Australia, New Zealand, the United Kingdom, the United States, Canada and Thailand.
  • Delivery times are estimates and depend on the postal service. We're not responsible for postal delays outside our control.
  • Make sure your delivery address is right at checkout. If it's wrong, email us straight away — once an item has been posted we may not be able to redirect it.
  • Customs duties or import taxes on international orders are your responsibility.
  • Faulty, damaged or incorrect items are covered by the Refund Policy.

9Services and design work

Website builds, graphic design, printing, translations, social media management, consultancy and lessons are agreed individually by email. The quote we send you sets the scope, the price and the timeline, and it sits alongside these terms.

  • Packages. Advertised packages include the page count, graphics allowance and free upgrade window described at the time you buy. Work beyond that scope is quoted separately.
  • Ownership. Where a package says you own the finished website, ownership of the delivered site passes to you once it has been paid for in full. We keep ownership of our own underlying tools, templates and know-how, and of any third-party or licensed material, which stays subject to its own licence.
  • Your materials. You confirm you have the right to use any text, images, logos or data you give us, and you accept responsibility for what's in them. We may decline work that appears to infringe someone else's rights.
  • Your input. Projects need timely feedback and content from you. Delays on your side move the timeline.
  • Portfolio. We may show completed work as an example of what we do, unless you ask us in writing not to.
  • Hosting, domains and third-party costs are yours unless the quote says otherwise.

10Intellectual property

Everything on this website — text, course content, books, graphics, code, logos, the WebPages.com.au name and layout — is owned by us or used under licence, and is protected by copyright.

You may read the site and use what you've bought as described in these terms. You may not copy, republish, scrape, mirror, resell or create derivative works from it without our written permission.

You may quote short extracts with attribution and a link, as you would any other source.

11Acceptable use

When using this site, you agree not to:

  • break any law, or use the site to harm, harass or defraud anyone;
  • attempt to gain unauthorised access to accounts, servers, gated content or paid downloads;
  • share paid content, links or access codes with people who haven't paid;
  • scrape, crawl or bulk-download the site, or attempt to overload it;
  • upload anything malicious, or anything you don't have the right to upload;
  • impersonate anyone, or misrepresent your connection with us.

Where the site lets you enter your own profile details, keep them lawful and appropriate. We may remove content that isn't.

12No financial advice

Read this before buying anything about trading or money

Everything we publish about cryptocurrency, trading, investing, business or making money is general information and education only. It is not financial product advice, not investment advice, not tax advice and not legal advice.

We are not licensed financial advisers and we do not hold an Australian Financial Services Licence. Nothing we publish takes into account your objectives, your financial situation or your needs.

Before acting on anything you learn from us, consider whether it suits your own circumstances and get advice from a licensed professional.

You should also understand:

  • Trading and investing carry real risk. Cryptocurrency in particular is volatile and largely unregulated. You can lose some or all of your money.
  • Past performance means nothing. Any result, chart, backtest, example trade or case study we show is illustrative and is not a prediction of future returns.
  • Automation multiplies risk. Bots, scripts and indicators we supply are teaching examples. They can contain errors, behave unexpectedly, or fail in live market conditions. Test with paper trading first.
  • Every decision is yours. We are not responsible for trades you place, positions you take, platforms you use or losses you incur.

Nothing in this section limits any right you have that cannot be excluded by law.

13No guarantee of results

Our courses, books and programs teach methods. They don't promise outcomes.

We don't guarantee that you'll make money, improve your English to any particular level, pass any exam, grow a business, or achieve any result described in our material. Results depend on your effort, your circumstances, your market and plenty of things none of us control.

Where we mention what someone has achieved, that's an example of what happened for that person, not a typical result and not something we're promising you.

14Third-party sites and services

This site links to services we don't control — including Stripe for payments, Facebook for the Companion Thailand Tours page, exchanges and charting platforms mentioned in course material, and other websites.

We're not responsible for third-party content, terms, pricing, availability or privacy practices. A link isn't an endorsement, and using those services is at your own risk under their terms.

Where a course names a specific platform, exchange or tool, that's for illustration. Do your own checks before trusting anyone with your money or data.

15Availability and changes

We try to keep the site up and working, but we don't guarantee uninterrupted access. Maintenance, hosting problems, outages and the general chaos of the internet all happen.

We may change, suspend or withdraw any part of the site or any product at any time. Where that affects something you've already paid for, we'll give you reasonable notice and a fair outcome.

16Liability

Your consumer guarantees still apply

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that can't be excluded by law.

Subject to that, and to the extent the law allows:

  • our liability for a failure to comply with a consumer guarantee is limited, at our option, to resupplying the goods or services or paying the cost of having them resupplied;
  • we're not liable for indirect or consequential loss, loss of profits, loss of opportunity, trading losses or loss of data; and
  • our total liability in connection with any product is limited to the amount you paid us for it.

You're responsible for keeping your own backups of anything important, including files you download from us.

17Suspension and termination

We may suspend or close your account, and withdraw access to paid content, if you seriously or repeatedly breach these terms — for example by sharing paid content, sharing access codes, or attempting to break into gated material.

Where we do that because of a breach, you're not entitled to a refund of what you've paid. If we close your account for any other reason, we'll refund the unused portion of any subscription.

You can close your account at any time by emailing us.

18Governing law

These terms are governed by the laws of Western Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state and of the Commonwealth of Australia.

If any part of these terms is found to be unenforceable, the rest keeps working.

19Changes to these terms

We may update these terms from time to time. The current version is always on this page, with the date it was last updated at the top.

Changes apply from when they're published. They don't retrospectively change the terms of a purchase you've already made.
